Extract from INDENTURE made the third day of November in the year of our Lord One thousand eight hundred and eighty three.

Between JAMES BURRIS of Cinderford in the county of Gloucester, Collier and ANN his wife (formerly ANN BUFFERY Spinster) of the first part, JOSEPH BUFFERY of number 9 Shireoaks near Worksop in the county of Nottingham, Collier of the second part, WILLIAM REECE of Christchurch in the Colony of New Zealand Farm Labourer and MARTHA his wife (formerly MARTHA BUFFERY Spinster) of the third part, CHARLES BEARD of Cinderford aforesaid Collier and MARY his wife (formerly MARY BUFFERY Spinster) of the fourth part, SAMUEL BUFFERY of Cinderford aforesaid Collier of the fifth part, RICHARD BUFFERY of the same place Collier of the sixth part, GEORGE TYE of the same place Miner and CHARLOTTE his wife (formerly CHARLOTTE BUFFERY Spinster) of the seventh part and FREDERICK HAWKINS BRETHERTON of the City of Gloucester Gentleman of the eight part. WHEREAS RICHARD COOPER late of Cinderford Knoll in the Township of East Dean in the County of Gloucester Yeoman deceased being at the date of his Will and the time of his death hereafter mentioned seised of or otherwise well and sufficiently entitled to the piece or parcel of land and hereditaments firstly hereinafter described for an estate of inheritance in the fee simple in possession free from encumbrances made and duly executed his last Will and Testament in writing bearing date the twentieth day of November One thousand eight hundred and fifty one whereby he gave and devised the said piece or parcel of land firstly described with other hereditaments unto and to the use of his Son in Law HENRY BUFFERY and HANNAH his Wife during their lives and the life of the survivor of them and from and immediately after the decease of such survivor to the use of his (Testators) Grandchildren being the lawful issue of the said HENRY BUFFERY and HANNAH his wife (except his (Testators) Granddaughter DINAH BUFFERY as should be living at the time of the decease of such survivor share and share alike as Tenants in common their heirs and assigns for ever And said Testator appointed DAVID DAVIS and the said HENRY BUFFERY joint Executors of his said Will and whereas the said Testator departed this life on the twenty fourth day of December One thousand eight hundred and fifty one without having revoked or altered his said recited Will and on the twelfth day of June following the same Will was duly proved by both the said Executors thereof in the Consistory Court of Gloucester and whereas by Deed Poll dated the nineteenth day of November One thousand eight hundred and fifty eight under the hand and seal of The Honourable JAMES KENNETH HOWARD the Commissioner of Her Majesty's Woods and Forests and Land Revenues the said JAMES KENNETH HOWARD granted the piece or parcel of land secondly hereinafter described unto the said HENRY BUFFERY and assigns for ever.

And whereas by a Deed Poll dated the nineteenth day of November One thousand eight hundred and seventy four under the hand and seal of the said JAMES KENNETH HOWARD the said JAMES KENNETH HOWARD granted the piece or parcel of land hereinafter described unto the said HENRY BUFFERY his heirs and assigns for ever. And whereas the said HENRY BUFFERY erected and built a Messuage or Dwellinghouse upon the said land secondly hereinafter described And whereas the said HENRY BUFFERY being under the impression that the land and premises devised by the said recited will to himself and his Wife the said HANNAH BUFFERY for their lives belonged to him absolutely and in fee simple made and duly executed his last Will and Testament in writing bearing the date the tenth day of February One thousand eight hundred and seventy six whereof he appointed DANIEL BRAIN and SAMUEL COOPER Trustees and Executors and thereby gave and devised to his Wife the said HANNAH BUFFERY the whole of the rents and profits arising from the Real estate for her use and benefit during her life And Testator willed and devised that the house with the appurtenances thereof with twenty perches adjoining thereto inclusive of the land taken up by the buildings thereto belonging should (being then in his own occupation) be equally divided between his Sons the said SAMUEL BUFFERY and RICHARD BUFFERY the House or half on the West side with the outbuildings on that side thereto belonging inclusive of ten perches of land or thereabout including the land taken up by the buildings should be for the said SAMUEL BUFFERY his heirs and assigns for ever and the house or half with the outbuildings thereto belonging on the East side with ten perches of land thereabouts inclusive of the land taken up by the buildings thereto belonging to be for the said RICHARD BUFFERY his heirs and assigns for ever, The Privy to be for the use of both houses And the said Testator devised that there should be a strip of land three feet wide for a road from the bottom of the land belonging to the said RICHARD BUFFERY the said land to be along the bottom of the land belonging to his daughter the said MARTHA REECE and to lead into the main road And said Testator willed and desired that the said SAMUEL BUFFERY should pay the sum of Twenty pounds to the said MARTHA REECE and also Twenty pounds to his Son the said JOSEPH BUFFERY And said Testator also willed and directed that the said RICHARD BUFFERY should pay to his daughter the said MARY BEARD the sum of Twenty pounds and also to his daughter the said CHARLOTTE TYE Twenty pounds And said Testator willed and devised that the said MARTHA REECE should have about ten and a half perches of land adjoining her house on the East side of the said RICHARD BUFFERYS land and bounded at the bottom or lower end by a road three feet wide leading from the said RICHARD BUFFERYS land to the main road leading to Ruspidge And said TESTATOR willed and devised that the said JOSEPH BUFFERY should have about eleven perches adjoining the said Road land at the bottom of the said RICHARD BUFFERYS and the said MARTHA REECE and also adjoining the land belonging to the said SAMUEL BUFFERY and Testator willed and devised that the said CHARLOTTE TYE should have eleven perches of land or thereabouts next to and adjoining the land belonging to the said JOSEPH BUFFERY And that the said MARY BEARD should have eleven perches or thereabouts of land adjoining the said CHARLOTTE TYES land being the lower or bottom piece of land etc etc
